1. Acceptance of Terms

By accessing or using Well-Kept (“the Service”), operated by Killian Naylor (“we,” “us,” “our”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

Well-Kept is a free style discovery platform that lets you browse products from heritage and independent brands, track prices, and build a personal Style Persona based on your preferences. The Service is available as a web application at app.wellkept.style and as a mobile app.

3. Accounts

You may browse Well-Kept without an account. To save preferences, build a Style Persona, and access personalized features, you must create an account using email/password, Google, or Apple sign-in through our authentication provider (Clerk). You are responsible for maintaining the security of your account credentials.

You must be at least 13 years old to create an account. By creating an account, you represent that you meet this age requirement.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to scrape, crawl, or extract data from the Service through automated means
• Interfere with or disrupt the Service or its infrastructure
• Impersonate another person or misrepresent your identity
• Upload harmful content or attempt to exploit security vulnerabilities

We reserve the right to suspend or terminate accounts that violate these terms.

5. Product Information and Pricing

Well-Kept aggregates product listings and pricing from third-party brand websites. We strive to keep this information accurate, but we do not guarantee that prices, availability, or product details shown in the app are current or error-free. When you tap “Shop” on a product, you are redirected to the brand's own website, and that retailer's terms and policies apply to any purchase.

Well-Kept does not sell products directly. We are not a party to any transaction between you and a third-party retailer.

6. Style Persona and User Data

Your Style Persona is generated from your swipe activity and preferences within the app. This data is associated with your account and used to personalize your experience. You may share your Style Persona publicly through your closet page if you choose. See our Privacy Policy for details on how we collect, use, and protect your data.

7. Intellectual Property

The Well-Kept name, logo, design, and original content are owned by us. Product images, brand names, and descriptions displayed in the app belong to their respective brand owners and are used for informational purposes. You may not copy, reproduce, or redistribute the Service or its content without our written permission.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Price alerts and product data are provided for convenience and may not always be accurate.

9. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to inaccurate product information, missed price alerts, or any transactions with third-party retailers.

10. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes through the app or by email. Continued use of Well-Kept after changes constitutes acceptance of the updated terms.

11. Termination

You may stop using the Service and delete your account at any time by contacting us. We may suspend or terminate your access if you violate these terms or if we discontinue the Service, with reasonable notice when possible.

12. Governing Law

These terms are governed by the laws of the United States. Any disputes arising from these terms or the Service will be resolved in accordance with applicable law.
